1. Agreement to Terms

By creating an account on medinex.com.au or using the Medinex SaaS platform, you agree to be bound by these Terms of Service. These terms apply to all NDIS providers, support coordinators, plan managers, and staff members ("Users") who access our services.

2. The Service

Medinex Pty Ltd provides a cloud-based software-as-a-service (SaaS) platform designed to assist NDIS providers with participant management, service booking, billing, and compliance reporting.

3. User Obligations and Conduct

  • Account Security: You must provide accurate information and keep your password secure. Multi-Factor Authentication (MFA) must be enabled where available.
  • Data Accuracy: You are solely responsible for the accuracy of the data you enter, including NDIS participant details and claim amounts.
  • Consent: You warrant that you have obtained all necessary consents from NDIS participants before uploading their personal or health information to the Medinex platform.

4. Fees and Payment

  • Subscription: Access is provided on a subscription basis (Monthly or Yearly).
  • Payment: Fees are billed in advance. If a payment fails, Medinex reserves the right to suspend access to the platform until the balance is paid.
  • Taxes: All fees are subject to GST (Goods and Services Tax) as per Australian law.

5. Intellectual Property

Medinex Pty Ltd owns all rights, titles, and interests in the software, including its design, code, and branding. You are granted a limited, non-exclusive license to use the platform for your business operations during your subscription period.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

  • Medinex is provided "as is" and "as available."
  • Medinex Pty Ltd is not liable for any NDIS claim rejections, loss of data caused by user error, or business interruptions.
  • Our total liability for any claim shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

7. Termination

You may cancel your subscription at any time via the billing portal. Upon termination, your access will end at the conclusion of your current billing cycle. Medinex will provide a 30-day window for you to export your data before it is permanently deleted from our active database.

8. Governing Law

These terms are governed by the laws of South Australia. Any disputes will be handled in the courts of Adelaide, SA.
